LEGAL ACT: EUROPEAN CITIZIN'S INITIATIVE (ECI)


LEGAL ANALYSIS

The Commission had received a mandate from the Council to negotiate a Transatlantic Trade and Investment partnership (TTIP) with the US.

An ECI to get this mandate annulled was refused by the Commission claiming that under this mandate is not a legal act.


CJEU:

→ There needs to be a WIDE INTERPRETATION of a legal act. Therefore, an ECI can be seen as a legal act, this follows from the principle of democracy (§37).
